1. GENERAL
1.1 Horizon Villas is the trading name of Horizon Villas Maintenance Company Limited whose registered office is in Koh Samui, Suratthani, Thailand
1.2 Horizon Villas is an owner of property available to let on a short or long term basis in Koh Samui, Thailand.
1.3 Accuracy of Web and other Information. Horizon Villas makes every effort to ensure that advertised descriptions and images are correct, however Horizon Villas reserves the right to make changes/improve the properties and services from time to time.
2. BOOKINGS
2.1 Initial Deposit – An initial deposit of 30% must be paid to confirm a booking within 10 banking days. Payment can be made by direct bank transfer to:

A damage deposit of 500 US$ must be paid on arrival and will be returned on checkout subject to the villa inspection at the end of the rental.
2.2 No contract will exist between you and Horizon Villas until Horizon Villas has received and accepted the deposit payment and the completed booking form.
2.3 Your reservation will be confirmed upon payment of a deposit.
2.4 If payment has not been received within 10 banking days, Horizon Villas will assume that you have cancelled the reservation.
2.5 Balance Payment – Payment of the outstanding balance is due 30 days prior the arrival date and Horizon Villas will send out a reminder close to the due date. If the booking is made within 30 days of the arrival date, 100% of the cost of the property rental shall be due at the time of booking. Payment can be made by direct bank transfer as above (2.1)
2.6 Included in the Rental Rate:
2.6.1 Villa rental
2.6.2 Utilities (Electricity and water)
2.6.3 Twice weekly maid service
2.6.4 All Linen and towels
2.6.5 Airport Transfers
2.6.6 Call out service to repair any equipment problems
2.7 Excluded in the Rental Rate:
2.7.1 Car rentals and other transport charges
2.7.2 Food drinks and other consumables
2.7.3 Cancellation Insurance
2.7.4 Insurance for personal possessions
2.7.5 Excessive cleaning charges (e.g. upholstery)
2.8 Long Term Rentals (over 3 months) different terms apply, please request information from Horizon Villas.
2.9 Car rentals, initial stocking of food, plus additional maid services can be ordered in advance at a nominal additional cost. These services should be ordered at the time of booking and are provided through the local management agent.
2.10 Any additional charges for breakages or for other services purchased through the local managing agent should be settled locally on check out. The Renter agrees to pay the owner for the cost of repairing or replacing (solely at the owner’s discretion) any item of property, or contents at the Villa, which is damaged due to negligence or willful default of the renter during the renter’s occupation, or which is missing. The person in whose name the booking is made acts on behalf of all other persons named, and becomes responsible to Horizon Villas for all payments in respect of the booking.
3. RENTER CANCELLATIONS
3.1 In the event that you have to cancel your booking at any time it should be noted that no refund will be made whatsoever.
3.2 It is a condition of the booking that the entire party is covered by comprehensive travel insurance, which will need to provide separately to your booking, such insurance should provide compensation to you in the event of cancellation (see Insurance).
4. CANCELLATIONS BY HORIZON VILLAS
Although it is unlikely that Horizon Villas will have to make any changes to confirmed arrangements, it is sometimes unavoidable in which case we will advise you at the earliest possible date. If, for any reason beyond our control, we are unable to provide you with the property booked, Horizon Villas shall reserve the right to cancel the reservation. For example, if the properties are damaged or rendered unusable Horizon Villas will try to locate an alternative property for the period required. However, if this is not possible, or you do not wish to be transferred, Horizon Villas will cancel the booking and refund you in full, less any bank transfer charges. Horizon Villas shall not be liable for any further obligations or claims by the client.
5. AMENDMENTS OF DATES
Horizon Villas will endeavor to accommodate changes in Booking dates wherever this is possible. This will be effected at no extra charge should alternative dates be available.
6. ARRIVAL & DEPARTURE TIMES
6.1 Guest should assume that Check-in time is after 3 p.m., and checkout time is prior to 11 a.m.
6.2 Horizon Villas will endeavor to accommodate early check-ins and late check outs if requested at the time of booking, however this cannot always be guaranteed.
7. REGISTERED GUESTS
7.1 Only those persons entered on the booking form may reside at the villa as guests. Please notify us as soon as possible of any changes
7.2 The number of people staying at the villa must not exceed the maximum capacity indicated by you on the Horizon Villas booking form, except in the case of infants (under two years old), or unless specifically authorized.
7.3 Should the owner or the local representative find that the number of people staying at the property exceeds that on the booking form, he may, at the absolute discretion of Horizon Villas, ask the extra person or persons to vacate the property forthwith.
7.4 No camping is permitted in the grounds or gardens adjacent to the villas.
8. INSURANCE
8.1 It is a condition of the booking that the entire party is covered by comprehensive travel insurance (including cancellation, flight delays, loss and damage to baggage and other property) and health insurance (including evacuation and repatriation coverage).
8.2 Horizon Villas is not responsible to you and your party for any and all claims including any accidents related to the use of the property facilities or locally procured third party services such as, watercraft, water sports, jeep or motorbike rental etc.
8.3 Horizon Villas will not be responsible for any delay, additional expense or inconvenience caused directly or indirectly by events outside our control such as civil disturbances, fires, floods, severe weather, acts of God, acts of Government etc.
9. COMPLAINTS
9.1 In the unlikely event of a problem with your rental property occurring, whilst you are in Koh Samui, the local management agent so that the matter can be attended to. If the situation cannot be resolved to your satisfaction, at the time, you may contact Horizon Villas, so that Horizon Villas is given the opportunity to try to assist. All claims must be addressed directly Horizon Villas.
9.2 Horizon Villas does not accept responsibility for the breakdown of the supply of water, or electricity, nor of swimming pool filtration systems, though we will use our best endeavors to arrange for any such problems to be solved quickly.
9.3 If there are any problems during the rental period, which could not be solved by dealing directly with the local staff, contact Horizon Villas immediately and Horizon Villas will use its best endeavors to rectify the situation.
9.4 It is understood that infrastructure, local standards and conditions are often of a less developed Horizon Villas will do as much as can be reasonably expected to avoid and rectify any problems that may occur, but cannot be held responsible for problems occurring. Any complaints must be notified to Horizon Villas within 24 hours of the problem occurring.
9.5 Should a problem remain unsolved please make a complaint in writing to Horizon Villas within 14 days of the completion of the rental period.
9.6 If the Villa is vacated before the end of the rental period without prior agreement with Horizon Villas or the property owner/manager, this may result in the loss of all rights to compensation.
10. CONDUCT & BEHAVIOUR
10.1 The person signing the contract is responsible for the correct and appropriate behavior of the guests staying at the property. Should any member of the party not behave in such a manner Horizon Villas, or the property manager may at their absolute discretion ask the offending guest or guests to vacate the property forthwith.
11. VALUABLES
11.1 Any valuables left at the property are left at one’s own risk. Neither Horizon Villas nor the owners or staff at the property is responsible for any loss or damage to valuables or other property.
12. JURISDICTION
Any contract that is made will be with the acceptance by both parties of these terms and conditions, which are governed by Thai law, and both parties will submit to the exclusive jurisdiction of the Thai courts.
13. AGREEMENT
13.1 These Terms & Conditions govern all bookings with Horizon Villas Maintenance Company Limited. Any booking made or order placed by you, whether through the Company’s website or otherwise, shall be deemed an offer by you to rent the relevant accommodation subject to these terms & conditions.
13.2 All bookings through our Company and all matters arising from them are subject to Thai law and to the exclusive jurisdiction of the courts of Thailand.
13.3 The person who makes the booking accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party. Booking services with the company are only available to persons who are at least 18 years old. By submitting a booking you warrant and confirm to us that you have read these Terms & Conditions and agree to comply with them.
